This paper deals with the right to wear religious symbols. To achieve this objective, the meaning of religious symbols is first analysed, distinguishing the different public spaces where people carry them. Secondly, the margin of appreciation enjoyed by the member States of the Council of Europe is studied and compared with the control of the conventionality of the case law of the Inter-American Court of Human Rights. Thirdly, this paper examines the case law of the European Court of Human Rights and that of the Court of Justice of the European Union on this matter. In addition, it contains a brief description of the case law of the Inter-American Court of Human Rights and of some of a State court. Fourth, the Spanish law and case law on the mentioned symbols is considered. Finally, some concluding remarks are added.
